eLeader website privacy policy

eLeader Sp. z o.o. provides this Privacy Policy to users of the eleader.biz website to inform them about the purposes of collecting personal data, as well as its collection and use. Personal Data is defined as data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). By providing your personal data on the website, you confirm that you have the necessary permissions to disclose personal data, which will be used by eLeader Sp. z o.o. in the manner described in this Policy.

Data Controller

The controllers of Users’ personal data are: eLeader Sp. z o.o., with its registered office in Lublin, ul. Nałęczowska 16, 21-701 Lublin, registered in the National Court Register under KRS number 0000193608, NIP 713-258-93-06, REGON 431273170, as well as Finanteq SA, with its registered office in Lublin, at ul. Nałęczowska 16, 21-701 Lublin, registered in the National Court Register under KRS number 0000521114, NIP 713-30-87-558, REGON 061722409.

Scope of personal data and its processing

In connection with a given Service, the Administrator may ask the User to provide, in particular, the following personal data: first and last name, phone number, and email address. During the recruitment process, providing personal data to the extent required by the Labor Code is mandatory. In other cases, personal data is processed based on the User’s voluntary consent; however, failure to provide such data prevents the use of the Service in question. The User gives consent by checking the appropriate box on the form during the procedure intended to enable the use of the Services.

The Administrator processes Personal Data for the purpose of:

• sending Users, to the email addresses or phone numbers they provided, responses to previously submitted inquiries sent via the contact form, provided that the User has consented to receiving them. The data will be processed until the User withdraws their consent.
• sending Users, to the email addresses they provided, a newsletter containing information about new offerings from the data controller, articles, reports, and market analyses. The data will be processed until the User withdraws their consent.
• the recruitment process. Data processed for the purposes of the current recruitment will be processed until consent is withdrawn, but no longer than 6 months from the moment consent is given. Data processed for the purposes of future recruitments will be processed until consent is withdrawn, but no longer than 3 years from the moment consent is given.

The controller processes personal data on the basis of:

  • Article 6(1)(a) of the GDPR—consent of the data subject,
  • Article 6(1)(b) of the GDPR—performance of a contract or taking steps prior to entering into a contract,
  • Article 6(1)(c) of the GDPR – a legal obligation to which the Controller is subject,

Article 6(1)(f) of the GDPR – the Controller’s legitimate interests (e.g., proprietary marketing, analytics).

Data Sharing

To the extent necessary to provide certain services, data may be shared with entities cooperating with eLeader Sp. z o.o., in particular:

  • IT service providers,
  • hosting companies,
  • providers of analytics and marketing tools (e.g., Google),
  • entities providing accounting and legal services,
  • authorized state authorities in connection with proceedings they are conducting, upon their request and after the conditions confirming the necessity of obtaining such data from us have been met.

Each of these entities receives data to the extent necessary to perform the relevant service. Some personal data is transferred outside the European Economic Area to the United States due to the location of these entities’ data processing centers, based on Standard Contractual Clauses (SCCs) approved by the European Commission.

User Rights

The data subject may exercise their rights by contacting the Controller.

Requests regarding the processing of personal data may be submitted, in particular, regarding:

  • access to data,
  • correction of data,
  • deletion of data,
  • restriction of processing,
  • data portability,
  • objection,
  • withdrawal of consent (if processing is based on consent).

The Controller will respond without undue delay, no later than within 1 month of receiving the request.

If the request is complex, this period may be extended by an additional 2 months, of which the data subject will be informed. The data subject has the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.

Profiling

The controller may use profiling of personal data, which involves the automated processing of user data to evaluate selected factors relating to the user.

Profiling may be used in particular for the purpose of:

  • tailoring the content displayed on the website to the user’s preferences,
  • conducting marketing activities, including behavioral advertising,
  • analyzing user behavior on the website.

The results of profiling may include, in particular:

  • displaying personalized content,
  • tailoring offers or marketing messages,
  • optimizing website performance.

Profiling does not lead to decisions that have legal effects on the user or similarly significantly affect them.
